Danaher’s Labor & Employment Legal team provides timely legal services that are strategic, sound, pragmatic, and impactful and aligned with the goals of the business –

– through partnership and collaboration with our clients.
As a member of the Danaher Labor & Employment Legal team, the US Labor & Employment Counsel and L&E Program Manager will report directly to the Lead Counsel – U.S.
Labor & Employment, and will provide Danaher’s operating companies (“OpCos”) practical legal advice and creative, broad impact solutions on a wide variety of employment and labor law issues in the United States; develop and implement best practices and training for U.S.
Human Resources personnel and other cross-functional stakeholders; manage and drive strategy on litigation and other adversarial L&E matters; manage and timely drive to completion L&E related projects and/or participate in cross-functional projects as a U.S.
L&E legal subject matter expert.
Key Responsibilities:
- Provide practical and timely guidance and support regarding the legal aspects of the employment relationship with our associates and the compliance with the myriad federal, state, and local laws in the U.S.
that govern this relationship and the workplace including those concerning discrimination, harassment, wage and hour, restrictive covenants, leaves of absence and accommodations, individual and group separations, “whistleblowing,” and the requirements imposed by applicable Executive Orders and OFCCP regulations, including affirmative action plan requirements and will also provide support and guidance in connection with OFCCP audits as applicable
- Assist U.S.
OpCos and the Danaher Corporate North American Labor & Employee Relations Center of Excellence (“LER COE”) in HR-related investigations/audits including overseeing third party investigators, supporting internal OpCo and North American LER COE investigators and sometimes personally conducting such investigations
- Help educate our Human Resources community and North American LER COE about applicable legal requirements, labor and employment best practices through on-going counseling and advice
- An essential component of the position is the development of best practice Labor & Employment Legal solutions that are creative, efficient, practical, and compliant and can be effectively scaled across the diverse U.S.
OpCos.
This work involves the design and implementation of process-oriented solutions that include best templates, policies, and accompanying trainings for OpCo HR, LER COE, and other stakeholders.
- Champion the adoption of the Danaher Labor & Employment Legal team’s best practice solutions across a highly matrixed organization, through training programs, on-going counseling and advice, and building and managing strong relationships in a highly matrixed organization.
- Manage and timely drive to completion other L&E related projects, including internal compliance reviews, new policy roll-outs and implementation, and training programs.
- Participate in cross-functional projects as a subject matter expert on U.S.
L&E legal implications.
- Liaise with the North American LER COE and provide legal guidance and advice on labor and employee relations matters, training, and best practices
- Represent our operating companies before various federal and state government agencies and manage charges filed by associates with such agencies ( e.g ., EEOC, DOL, NLRB, etc.), including developing strategy for the successful resolution of such matters, preparation of position statements, responding to information requests, managing the administrative investigation process and playing a key role in any mediation or litigation of such charges
- Manage and drive strategy of employment litigation including the development and execution of effective litigation management and settlement strategies; manage the discovery process; and ensure proactive legal advice is effectively and efficiently delivered in order to mitigate present and potential future risk and exposure
- Work effectively with outside counsel and report effectively on matters to the Lead Counsel – U.S.
L&E
- Prepare various employment-related agreements, such as separation, contractor, and fixed term agreements
- Review, revise and prepare OpCo L&E policies and handbooks
- On the labor side this person will assist in union awareness activities and in keeping our facilities union free.
In plants where we have unions, this person will provide legal support to the operating company in connection with union matters ranging from contract negotiations, unfair labor practice charges, and grievance and arbitration matters.
- Support clients in various states in the U.S.
across different business platforms
- Work closely with and timely and clearly communicate U.S.
L&E issues and matters to the DHR L&E Legal team
- Keep abreast of developments in U.S.
labor and employment case law, statutes, regulations, and best practices and identify, develop, and implement strategies for compliance and minimizing risk.
Required Skills and Experience:
- J.D.
from an accredited law school
- Must be an experienced L&E attorney with 7-10 years of L&E practice who has worked at a major law firm, with in-house experience a plus, and has successfully led a variety of substantive U.S.
L&E matters to conclusion including employee disputes, dispute resolution (litigation, ADR), labor negotiations, and internal investigations
- Expert substantive knowledge of major U.S.
employment and labor laws and regulations; experience with Canadian labor and employment law a plus
- Significant experience in HR-related investigations and management of investigations
- Experience managing labor and employment related projects, and preparation and presentation of L&E training/educational materials
- Experience with federal contractor regulations, AAP and OFCCP audits a big plus
- Ability to effectively present to large HR, legal and business groups in both on-line and in-person settings
- Experiences that demonstrate a process-oriented mindset and ability to scale subject matter expertise and learnings to develop practical standard work and best practices with broad impact across a matrixed organization
- Experiences that demonstrates an ability to function independently and effectively in a complex, matrixed organization a must
- Ability to work extended hours as needed and support clients in different time zones
- Ability to travel domestically as needed, perhaps as much as 25-30% of time in some periods

L&E and other members of the Danaher L&E Legal team, and other stakeholders
- Able to communicate and explain the federal and state employment environments and situations to HR and business leaders who possess varying degrees of sophistication about legal matters and able to take business concerns and demands into account in various situations
- Able to provide and apply legal recommendations and advice in pragmatic and implementation-oriented manner
- Intelligent, analytically detailed and precise, articulate, and possessing excellent oral and writing skills that can translate complex legal concepts into plain-English practical legal advice and solutions for a variety of stakeholders and client groups
- Able to prioritize and meet deadlines in a fast-paced, high volume, and able to pivot and reprioritize to meet the needs of a frequently changing environment
- Able to command the respect of, and influence, HR and business leaders and internal and outside counsel across a wide spectrum of experience and sophistication
- Displays ability to hold to professional opinions and convictions and take stand on critical issues
- Consistent demonstration of ability to timely define and analyze problems, assess risks, and recommend legally sound and well-reasoned practical solutions, including in situations of high complexity and ambiguity and incomplete information
